Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website topgentik.com and the AI agent platform offered by TOPGENTIK Pte. Ltd. (“TOPGENTIK”, “we”), a company incorporated in Singapore. By accessing the website or engaging our services, you agree to these Terms.

1. Service description

TOPGENTIK designs, builds and operates AI agents for enterprise customers, including conversational agents that interact with prospects and stakeholders via voice, SMS, email and WhatsApp Business messaging, integrate with customer ERP and operational systems, and produce summaries and proposals on the customer’s behalf.

2. Eligibility

You may only use the Service if you are at least 18 years old and authorised to enter into a binding agreement on your own or your organisation’s behalf. The Service is intended for businesses, not for personal or consumer use.

3. Acceptable use

You agree not to use the Service to: (a) violate any applicable law; (b) send unsolicited communications, spam, or content prohibited by the messaging platforms we operate on (including Meta WhatsApp Business policies and Twilio acceptable use policies); (c) infringe intellectual property or privacy rights of third parties; (d) attempt to reverse-engineer, probe or disrupt the Service.

4. Customer obligations

When you engage TOPGENTIK as a customer, you are responsible for: providing accurate information about your organisation; ensuring you have the right to share with us the data we will process on your behalf; obtaining the appropriate consents from your prospects and contacts before we engage them on your behalf; and complying with any sector-specific regulation applicable to your business.

5. Intellectual property

The TOPGENTIK platform, agent runtime, prompts, skills and codebase are the exclusive property of TOPGENTIK Pte. Ltd. Customer-specific configuration, data and content remain the property of the customer.

6. Confidentiality

We treat customer data and operational information as confidential and use it only to deliver the Service. Our staff and sub-processors are bound by equivalent confidentiality obligations.

7. Disclaimers

The Service is provided on an “as is” basis. AI agents may produce inaccurate or unexpected outputs; customers are responsible for human review of automated outputs that have legal, financial or operational impact. We make commercially reasonable efforts to keep the Service available but do not guarantee uninterrupted access.

8. Limitation of liability

To the maximum extent permitted by law, TOPGENTIK’s aggregate liability arising out of or in connection with the Service shall not exceed the fees paid by the customer to TOPGENTIK in the twelve months preceding the event giving rise to the claim.

9. Governing law

These Terms are governed by the laws of Singapore. Disputes shall be submitted to the exclusive jurisdiction of the courts of Singapore, without prejudice to mandatory consumer rights under your local law.

11. Changes
